The European continent has always been the arena for migratory movements. For this reason, migration issues have been the subject of important political and legal debates and developments in Europe. In recent years, the flows of migrants arriving from countries affected by wars and dangerous and difficult life situations have challenged not only the migration policies of the old continent but also the functioning and stability of European institutions. These institutions were faced with a major dilemma in applying international and national standards in the matter in a very tense political and social situation. The Afghan crisis is only the most recent example.
The presentation on "Migrant’s rights in Europe" aims to briefly present and discuss the major developments in case law of the two European courts, the ECHR and the CJEU. Several of these judgments have prompted or helped the adoption of important reforms in the field of European migrant law.
About the speaker
Ledi Bianku is an Associate Professor at the University of Strasbourg and Associate Attorney at Doughty Streets Chambers, London. He is a former judge of the European Court of Human Rights (2008-2019), and former member of the Venice Commission for Democracy through Law (2006-2008). He has authored numerous publications in French, English, Italian and Albanian, on European human rights law, European Union law and public international law.
