Background
The principles of independence and impartiality are fundamental to a proper administration of justice, and are intensively debated in particular in connection with investment arbitration.
Following the work made at the International Academy of Comparative Law’s XXI
Congress, the matter is analysed in the book Independence and impartiality of International Adjudicators (Giuditta Cordero-Moss (ed.), Intersentia 2023.
The book refutes some of the assumptions commonly made in the ongoing debate on the reform of investment arbitration. In particular, a comparative analysis of the mechanisms in international courts does not confirm the assumption that a permanent court would resolve issues of legitimacy that are currently discussed in connection with investment arbitration (such as conflict of interests, double-hatting and issue conflict).
Program
Two of the Special Reporters who contributed to the book, Fabien Gélinas (McGill University) and Yuliya Chernykh (Inland Norway University), and the General Reporter of the book, Giuditta Cordero-Moss (University of Oslo), will discuss the issue of independence and impartiality in investment arbitration with Geir Ulfstein (University of Oslo).
The workshop will be primarily in person, but it will also be possible to participate remotely. The event is free and open to all, but we kindly ask you to register for the event.
