Associate Professor ISHII is an international lawyer and a member of a Japanese research group on the subject of cross-border evidence, financed by the Japanese Bar Association. This research group has assembled domestic court decisions and state practice on the subject from all over the world, including Norway and the Norwegian Supreme Court decision in the Tidal-case. Her presentation will focus on a recent decision on the subject by The Supreme Court of Japan, in which it was held that remote access to a foreign server for a criminal investigation is permissible when conditions of the Cybercrime Convention of 2001 are met. She will also explain the general relationship between Japanese law and international law, and present some of her observations from the work of the cross-border evidence research group.
