The Sustainable Finance Disclosure Regulation’s classification of sustainable funds

Abstract

The theme for this master thesis is the sustainable finance disclosure regulation’s product-level disclosure requirements, which depend on the financial products classification under the same regulation. The thesis focuses on funds, and asks the following research questions:

  1. What are the material requirements that a fund must meet in order to be classified as an Article 8 fund or an Article 9 fund? The questions seeks to clarify the difference between Article 6, Article 8 and Article 9 funds.
  2. What legal effects follow the classification as an Article 8 fund and an Article 9 fund?
  3. Which legal consequences can a fund manager potentially face if a fund is shown to have been managed in violation of its classifications requirements? Consequences in both public law and private law are relevant.

During this presentation I will present my work so far, and go through different interpretation issues and questions that I have stumbled on. The goal is to get valuable input and ideas from the participants, which can help me before the final stages of the thesis. At this stage I have mainly worked on the first research question, which will be the presentations main focus. The other research questions will be presented more briefly.
