Public procurement in the Anthropocene: Are contracting authorities free to disregard sustainability?

Abstract

Are contracting authorities free to disregard sustainability? Yes, according to most commentators. If true, then sustainable public procurement remains a matter of policy discretion, not EU law. Challenging this view, Directive 2014/24/EU is reinterpreted in light of the general principle of sustainable development, enshrined in the Treaties and Charter. It also gives examples of when economic operators can sue contracting authorities for expectations damages for their failure to give sustainability due consideration.

Nodland is writing a Master thesis and will present his work so far. The goal is to get valuable input and ideas from the participants.
