Abstract
In this work in progress seminar, Beate Sjåfjell and Jukka Mähönen present their paper Interdisciplinarising Legal Theory: Towards a Reconceptualisation of Business Law. The aim of the seminar is to discuss the paper and receive feedback before the authors submit the paper to a journal.
In the paper the authors call for a reconceptualisation - a reclaiming - of business law theory. They identify limitations in prevailing legal theory and notably in the dominant theories underpinning business law. They show that the primary reason for these limitations is the simple economics-based methodologies employed in prevailing business law theories during the last decades. They propose a new interdisciplinary and systemic approach to legal theory as a way forward, drawing on an empirical recognition of the complexity of reality, and the interconnectivity and interaction of law and other societal institutions as elements of social-ecological systems. The paper concludes with reflections on the urgency of discipline-bridging approaches in research, to develop foundations for change towards a sustainable future.
