Interdisciplinarising Legal Theory: Towards a Reconceptualisation of Business Law

Abstract

In this research paper, Beate Sjåfjell and Jukka Mähönen call for a reconceptualisation - a reclaiming - of business law theory. They identify limitations in prevailing legal theory and notably in the dominant theories underpinning business law. They show that the primary reason for these limitations is the simple economics-based methodologies employed in prevailing business law theories during the last decades. They propose a new interdisciplinary and systemic approach to legal theory as a way forward, drawing on an empirical recognition of the complexity of reality, and the interconnectivity and interaction of law and other societal institutions as elements of social-ecological systems. The paper concludes with reflections on the urgency of discipline-bridging approaches in research, to develop foundations for change towards a sustainable future.
