I HR-2021-1773-A tok Høyesterett stilling til den ulovfestede læren om selvstendig rettsvernshevd. Læren var i forkant av HR-2021-1773-A omdiskutert i teorien, særlig etter at Høyesterett avviste anvendelsen av selvstendig rettsvernshevd i HR-2017-33-A. Under miniseminaret diskuteres rettstilstanden etter HR-2021-1773-A, herunder hvilke materielle og metodiske implikasjoner som kan utledes fra kjennelsen.
