Regulatory challenges in implementing EU legislation on data and artificial intelligence

About the project

Technological areas of law, or areas of law that are strongly affected by technological development, present particular challenges. Legislation in these areas needs to keep pace with rapid developments, while premature regulation can also have unfortunate and unintended effects. This is a challenge, and the problems are compounded when the EEA legal dimension must be taken into account. The new EU regulations in the field of data and artificial intelligence are complicated and largely cross sectoral. Furthermore, they do not answer all relevant legal questions that arise, in particular at the interface between data rules and other EU or national rules. This may pose challenges for national legislators. Moreover, it is conceivable that in some cases solutions within the EU regulatory framework, based on legitimate arguments and considerations, may still be in tension with the integration of EU/EEA Law. 

This project will explore some of the issues that arise in this context. The aim is to provide new insights into how certain challenges in the regulation of new technologies can be addressed from an EEA perspective. The first article deals with questions related to Generative AI and the use of copyrighted works to train such AI systems. Thus, this article will mainly discuss regulatory options following the implementation of the Directive on copyright and related rights in the Digital Single Market, which contains a provision on the use of works for text and data mining activities for commercial purposes. Other articles in the project will examine various other issues related to the EU’s new AI Act and other EU data regulation. The work is part of the EURNOR project.

Goal

The PhD will be delivered spring 2028.
