Prosjektet "Anglo-American Contract Models" har nå utkommet med sin prosjekt-publikasjon nr. 5 "Begrepene "conditions", "warranties", "representations" og "covenants". Arbeidet er en bearbeidet versjon av Tor Sandsbraatens spesialoppgave som ble skrevet mens han var vitenskapelig assistent ved Institutt for privatrett.

"Most commercial contracts that are written in the English language divide the terms into several categories: conditions, representations, warranties, covenants and terms. Contract practice shows that each category is used for undertakings with their own, peculiar characteristics.

This paper analyses the original function of the categories conditions, representations, warranties and covenants. It uncovers that it is base on various peculiarities of English law of contracts, before verifying to what extent it is compatible with Norwegian law.

The paper is based on the work carried out as a research assistant at the Department of private law, University of Oslo, in the frame of the research project "Anglo-American Contract Models and Norwegian or other Civilian Governing Law".
