Abstract
At a LEVEL project workshop in December 2022, my contribution looked at the principle of solidarity in EU law. The main aim was to establish, in a general sense, that solidarity has legal qualities and therefore imposes concrete obligations. The specific obligations of procedural solidarity were also introduced in that context. This presentation outlines subsequent work that further develops the features and implications of procedural solidarity in the context of free movement and residence rights. It addresses two main questions. First, what material differences does reading the law through the prism of procedural solidarity make? And second, do obligations of procedural solidarity developed under EU law apply also to the rights conferred by the EEA Agreement?
