Towards a New Legal Framework for AI: Rethinking the 'By Design' Approach in AI Regulation -- an Israeli Perspective

The proposed Artificial Intelligence Act of the European Commission advances a by-design regulatory approach, akin to the principles of the GDPR. This approach assumes that in order to effectively shield human rights in the digital ecosystem it is necessary to incorporate ethical principles into the design of the system.  

 

This presentation will revisit the by-design regulatory approach, drawing lessons from the Israeli deployment of Contact Tracing Technologies during the Covid-19 pandemic.

Niva Elkin-Koren is a Professor of Law at Tel Aviv University Faculty of Law and a Faculty Associate at the Berkman Klein Center for Internet & Society at Harvard University. She studies the intersection of law and information technology, focusing on values in design, intellectual property, governance by AI and governance of AI. She is a co-director of the Algorithmic Governance Lab at TAU Innovation Lab (“TIL”) and a member of the Academic Management Committee of TAD - TAU Center for Artificial Intelligence and Data Science.
