CompLex 3/23 - Voice as the Window to the Soul: Analysis of the Level of Protection Granted by the GDPR to Emotions Inferred from One’s Voice

This report examines the regulation of emotion recognition systems under the EU's General Data Protection Regulation (GDPR), focusing particularly on systems that infer emotions from voice.

The report considers three questions: (i) are emotions personal data as defined by Article 4(1) GDPR?; (ii) are emotions a special category of personal data as listed in Article 9(1) GDPR?; (iii) to what extent is it transparent to individuals that their emotions are being processed? The report was researched and written under the aegis of the project "Vulnerability in the Robot Society" (VIROS) funded by the Research Council of Norway.
