Under what conditions, if any, is the use of physical force and violence in policing legitimate? The aim of the present dissertation is to elaborate and defend a moral framework that may help to answer that question, which is of great social interest. The discussion takes place at the junction of ethics and legal philosophy and draws upon the broader critical examination of force and violence in the philosophical literature before being applied to a policing context. The overall aim is to establish that there are certain (deontological) constraints on the use of force and violence by the police, and that these moral constraints are embedded in the law. In so doing, the author takes a stand against influential schools in the contemporary debate, such as utilitarianism and legal positivism.
The stage is set in chapter 1, in which the author presents what he terms a case of poetic justice, an actual incident involving the use of firearms by the Norwegian police. The need for theorising about coercion, force and violence is thus embedded in a real-life situation. In Part One the key concepts of coercion, force and violence are clarified and defined, and the much-discussed doctrine of double effect is defended and related to policing. In Part Two human rights statutes are examined with a view to uncovering moral constraints on the use of force and violence by the police similar to those implicit in the doctrine of double effect. The relevance of moral constraints to the interpretations of the law is defended against the doctrine of legal positivism. Part Three returns the reader to the case of poetic justice, and applies the results of the preceding normative discussions. The author argues that in their use of firearms the Norwegian police transgressed the moral standards inherent in the law and thus in the standards to which as police they should adhere.
