Background and positions
Jon T. Johnsen was born in 1942. He holds a law degree (cand. jur.) from 1969 and a PhD in law (dr. juris) from 1986, both at the University of Oslo. He has worked as research assistant at the Department of Public and International Law, deputy judge at the city court of Tromsø, research fellow at the University of Tromsø and researcher at the Institute for Sociology of law at the University of Oslo, on a legal aid project commissioned by Norwegian Ministry of Justice. Between 1978 and 1990 he held a position as an assistant and then associate professor at the Institute for Sociology of Law and supervised Juss-Buss – a student legal aid clinic. In 1990 he became professor at the Department of Public Law and has taught criminal procedure and criminal justice, lawyers’ law and clinical subjects. He left his professorship due to compulsory retirement in 2012 and has since worked as professor emeritus. He was elected Vice Dean at the faculty of Law 1992-1994 and Dean 2004-2007.

Between 1990 and 1993 he also held a part time professorship at the Institute for Law at Tromsø University teaching sociology of law. He visited University of California, Los Angeles in 1989-90, University of California, Berkeley in 1995-96, The Law Faculty at Copenhagen University in 2002 and 2009 and was invited as IUEU Distinguished Research Fellow at Flinders University, Adelaide, Australia in 2008.

Research
Johnsen’s main research fields are sociology of law, legal aid, human rights and access to justice, criminal procedure and interdisciplinary issues. He has participated in international research projects on legal aid and the legal profession. Developing the student legal aid clinics at the Law Faculty in Oslo and later at the University of Tromsø has been important to him. He has drafted public reports for The Ministry of Justice on legal aid and criminal justice.

Other commissions
Johnsen has been elected as head of the Institute of Sociology of Law, vice dean (1992-94) and dean (2004-2007) of the Faculty of Law. He has been member and leader of commissions that reformed the law study in Oslo during the 1990ies. From 2003-2019 he served as an expert member and later invited expert of the European Commission on the Efficiency of Justice under the Council of Europe and has participated in Court Development Project in Turkey, Albania and Kosovo. He was hired as an independent expert by the Ministry of Justice with the task to supervise the implementation of a governmental policy report on major reforms in Norwegian legal aid from 2007-2010. In 2010 he evaluated the new Croatian legal aid act together with two other independent experts, on the commission of the Croatian Human Rights Institute. He has served as head of the complaint board at The Norwegian University of Life Science from 2012 to 2021.

For a long time, civil justice was considered to be a purely national, conservative, and slow-changing topic. The texts collected in this book supply proof that this is not the case anymore. These papers discuss civil justice from a European angle, concentrating on the age-old dichotomy between quality and efficiency. One of the developments that has triggered civil justice to become an international discipline is the establishment of the European Commission for the Efficiency of Justice (better known by the acronym of its French name, the CEPEJ) on 18 September 2002 by the Council of Europe. The mandate of the CEPEJ is to analyse the results of the various judicial systems of the Member States of the Council of Europe, to identify the difficulties these systems encounter, to develop concrete ways to improve them, and to evaluate the functioning of these systems. Various papers in this volume address the CEPEJ and its work, as well as other issues of civil procedure in Europe, such as legal aid and ADR and the influence of European developments on the reform of national civil justice systems. Consequently, the book provides an overview of the most recent ideas and developments in the field of civil justice. These ideas and developments show that although the values of the old tradition of European ius commune are still alive, they have been modified and expanded to such an extent that the organisation of efficient civil justice systems has become a feasible option for national legislatures.

Skal vernet etter menneskerettskonvensjonene sikres gjennomslag i norsk rett, må eksisterende interne regler som er i konflikt med menneskerettsvernet endres. Med utgangspunkt i straffeprosessreglene, blir det i artikkelen stilt spørsmål om lovgiver bør spille en mer aktiv rolle enn hva som hittil er gjort. For lovgiver kan det ha fortont seg som riktig å la domstolene uforstyrret få utvikle sine justeringsmetoder for internretten, men etter forfatterens oppfatning viser erfaringene at det er behov for en mer aktiv lovgiverinnsats.

The paper adresses the Report on European Judicial Systems 2002 issued by the European Comission on the Efficiency of Justice, and comments on its usefulness in combatting delays in European judicial systems. Three issues are discussed, 1) the problems of comparing statistics on time use, 2) some challenges in developing common standards for optimal time frames for the diverse European jurisdictions, and 3) measures to bring actual time use in better accordance with optimal time frames.

In our paper we describe and analyse the recent reforms to Finnish legal services policy. We summarise the details of the recent reforms and consider the initial evidence about their impact. The purpose of is to evaluate Finnish legal aid in a comparative perspective. We limit our analysis to other, rich western societies. We start with recent research and theory in order to propose a set of �best policies� of legal aid with which to assess Finland�s policy. We argue that to effectively promote the ideal of equality before the law requires an extensive policy of legal aid. Equality means that legal services are available to most members of the population and in respect of most legal problems. Effective legal access is required if equality before the law is to be achieved in practice. Our evaluation standards are explained in this section including the range of legal aid services that is implied. We draw on a pool of best policy principles gathered from research in many western industrialized welfare societies. We also examine recent empirical research that investigates the common legal problems people experience and how they respond to those problems. The implications of that research for the design of services are also considered.

Kronikken omhandler nedbygginggen av fri rettshjelp til samer. I behandlingen av Stortingsmelding nr 25 2000 om fri rettshjelp gikk justiskomiteen inn for å opprettholde og utvikle rettshjelptilbudet og etterlyste mer forskning. Rettshjelpkontoret Indre Finnmark skulle derimot bygges ned. Det var uretttferdig å ha bedre ordninger der enn andre steder i landet. Kronikken påpeker at nedskjæringen er rettet mot samer, og harmonerer dårlig med våre menneskeretts- og grunnlovsforpliktelser overfor samene som urfolk. En grundig, forskningsbasert evaluering utført av kronikkforfatteren og publisert i 1997 (Samisk rettshjelp, Tano Aschehoug)), viser at Rettshjelpkontoret Indre Finnmark har vært et meget vellykket rettshjelptiltak nettopp fordi det har valgt en utradisjonell form. Justiskomiteen kritisres for å overse dette og for å behandle innvandrere bedre enn samer når det gjelder diskrimineringsbeskyttelse.

The report has the need for and use of legal aid by Bulgarian Roma women as its main subject. It analyses the Bulgarian legal aid schemes that cover Roma women, and map their strengths and weaknesses with suggestions for improvements. The analysis includes both general legal aid schemes and special schemes like test schemes in Roma settlements. We only analyse a selection of legal aid challenges that we think important for Bulgaria to solve. The report aims at an objective overview of the system for delivering legal aid to vulnerable groups in Bulgaria. Such a perspective might easier identify reform issues and be helpful to national experts in their analyses. As Norwegian experts, we should independently establish a reasonably accurate picture of how Bulgarian legal aid to vulnerable people as Roma women works at present. According to the guidelines, the report should evaluate Bulgarian legal aid schemes from European and international standards. Our main purpose, however, is to produce recommendations about how Bulgaria might develop legal aid in ways that serve Roma’s legal need well, and especially the legal need of Roma women. In our analyses we summarize the legal and social circumstances that justify the need for reforms followed by our recommendations at the end of the discussions.
