Stiansen's dissertation is motivated by the fact that while the judgments of these courts (ECtHR and IACtHR) can have important political and legal consequences within respondent states, the regional human rights systems have few means of enforcing the judgments. Both the ECtHR and the IACtHR thus face implementation problems and these political considerations can influence the implementation process. Using novel compliance data, the dissertation examines different factors that might impact how implementation politics unfold.
The dissertation will be a compilation of four papers investigating how the implementation process is influenced by the need to enact legislative changes, the remedial strategy adopted by the court, the degree of political competition within respondent states, and dissent among the judges.
