The paper analyses jurisprudence of the WTO dispute settlement bodies and investor-state dispute settlement to determine whether the bodies take a common approach to the relationship between jurisdiction and applicable law, as a first step to understanding the impact of this relationship for the bodies to decide or apply other branches of public international law.

Dr Lorand Bartels (University of Cambridge) and Professor Valentina Vadi (Lancaster University) were the discussants of the paper and provided positive comments and constructive feedback on additional methods to analyse and solve the jurisprudential challenge presented in the paper as well as further theoretical scholarship to draw from.
