Foreldre med barn med funksjonsnedsettelser gjør ikke sjelden en formidabel og verdifull omsorgsinnsats både for det enkelte barn og samfunnet som helhet. Det er i mange tilfeller ikke bare ønskelig, men også nødvendig at foreldrene kompenseres for denne innsatsen økonomisk. Særlig gjelder dette hvis omsorgen for barnet går ut over mulighetene til å være i arbeid.
Denne avhandlingen belyser de viktigste «kompensasjonsrettslige» problemstillingene som oppstår ved foreldres omsorg for barn med funksjonsnedsettelser, og gir en rettsdogmatisk, sammenstillende analyse av fire prinsipielle aspekter ved fire sentrale ytelser. Ytelsesutvalget omfatter folketrygdlovens hjelpestønads- og pleiepengeordning, den kommunale omsorgslønnsordningen og barnets rett til erstatning for skaderelaterte merutgifter til pleie og omsorg. Aspektene som forfølges er betydningen av foreldres omsorgsplikter, forholdet til offentlige omsorgstjenester, kompensasjon for inntektstap og samordningen av de utvalgte ytelsene.
Arbeidet inngår i prosjektet «Et trygdesystem i sterk forandring», ledet av professor Asbjørn Kjønstad ved Institutt for Offentlig rett i Oslo, i samarbeid med Nordisk Institutt for Sjørett (NIFS).
English summary
Parents with disabled children make an incredible important and valuable effort, both for each individual child and for the society. In many cases, it is absolutely necessary that the parents are given economic compensation for taking the responsibility of the child's care fully upon themselves. This will often be the case if the child's condition makes it difficult to combine the role of carer with having a full time job.
This paper enlightens the most central questions regarding economic compensation schemes for parents with disabled children, and offers a descriptive analysis of the principal aspects regarding this group of carers specifically. National and municipal welfare schemes, tort law regulation, the parents' general obligation by law to provide proper care for their children, the relation to public welfare services, compensation for loss of income and difficulties concerning coordination of the different compensation schemes dealt with in the paper, are all subjects that are analysed.
