Successful Energy Law Club on ACER and EEA energy cooperation

On October 10th 2023, the Department of Energy and Resources Law of the University of Oslo organised an Energy Law Club dedicated to the question of the role of ACER and the energy cooperation under the EEA Agreement.

The seminar started with Dr. Torbjørg Jevnaker (FNI/CICERO) who gave a presentation of the evolution of ACER’s role and competences from the Third Energy Package to the Clean Energy Package. The specific role of ACER in the adoption and implementation of the network codes, guidelines and terms, conditions and methodologies (TCMs) was taken as a practical example. Thereafter, Anne De Geeter (EFTA Surveillance Authority) presented the manner ESA organises its cooperation with ACER under the EEA Agreement, including the legal basis for it.

The discussion moved forward to a review of ESA's decision on the Capacity Calculation Regions (CCRs) methodology of 24 April 2023, that included Norway to the Nordic and Hansa CCRs. Anne Elisabeth B. Wedum shared Statnett’s experiences with the decision-making process on network codes, guidelines and TCMs in general, and ESA Decision on CCRs methodology in particular. Professor Catherine Banet (UiO) introduced and moderated the discussion.
