Safeguarding of private positions in energy management

About the project

Political investment in greater socially beneficial measures creates a lot of engagement – most recently with the wind power initiative. Conflicts of interest have led to significant delays for several projects in recent years and the structure of the administrative institute has become a political issue. In this context, it is important to consider how private positions are safeguarded in the decision-making process, both during the licensing procedure and in the subsequent expropriation assessment.  The topic of the project is the relationship between the licensing process and the expropriation protection at new energy plants, with a particular look at the possibility of legal clarifications. An underlying purpose will be to take a closer look at the limits, possibilities and challenges of freedom of regulation. 

Relevant questions that will be investigated are:

  • How the licence affects and is affected by later circumstances
  • The landowner's legal position in the event of lengthy public decision-making processes
  • Consequences of a more plan-based energy management

Objectives

The project is scheduled for completion in 2026.
