The Polisario saga: the Principle of Good Administration and the Interface between EU Law and International Law

Abstract

The ongoing Polisario saga revolves around the contested extension of the EU-Morocco liberalisation and fisheries agreements to Western Sahara. It invites us to reflect on the relationship between EU law and international law through the principle of good administration. Although relying on procedural elements stemming from this principle, the extension of the agreements has been premised on a dubious detachment of socio-economic development aims from political processes.

The presentation argues that a deeper conception of the principle of good administration calls for a more thorough engagement in motivating discretionary choices. Adequate motivation and argumentation bring to the fore the relation between procedural frameworks and the ensuing substantive politico-legal stances.

About the speaker

Alessandro is a Postdoctoral Fellow at the University of Oslo and visiting Max Weber Fellow at the European University Institute. He holds a PhD from Sciences Po Paris. His principal interest is in the relationship between EU law and international law, with a focus on the European Union’s neighbourhood.
