About the presentation

In recent years, the digitalization of Chinese courts has received more attention and has led to debates among academics and legal practitioners. In China, concepts like “smart court” or “intelligent court” have been used in reference to the digitalization of courts. During the COVID-19 pandemic, information and communication technology played an increasingly important role in judicial activities.

More generally, digitalization of courts refers to litigation activities such as case-filing, court trial, execution, service and preservation that can be carried out online with the assistance of modern technology like big data, cloud computing, artificial intelligence and high-tech equipment. This is considered to improve judicial efficiency and conveniency, contribute to judicial disclosures, and establish judicial big data. However, the lack of transparency and consistent guidelines might undermine the application of digital means in the judiciary.

During this lecture, Wen Xiang will investigate the progress made in the digitalization of courts in China. He will also analyze the opportunities and challenges of the digitization process of Chinese courts and provide a perspective on possible implications for China’s recent diaspora governance in judicial matters.
